These Terms of Service ("Terms") govern your use of this website, including viewing and downloading photos and participating in photo shoots. By accessing or using this website, or booking a photoshoot you agree to be bound by these Terms and our Privacy Policy.

1. Photo Shoots

wheelsnvisuals is available for hire for automotive photo shoots. Interested parties may inquire about these services using the contact button on the wheelsnvisuals homepage.

Pricing: Pricing will be provided upon request. wheelsnvisuals retains the right to change the pricing at any time.

Payment: Payment for photo shoots must be made by bank transfer before access will be granted to the final images.

Refunds: Refunds are only provided in the event of a serious failure on the part of wheelsnvisuals to deliver the agreed photographic service (for example, non-attendance, technical failure resulting in no usable images, or circumstances where the shoot cannot be completed as agreed). Dissatisfaction based on personal taste, style, preferences, or subjective expectations does not constitute grounds for a refund. Where an issue arises, wheelsnvisuals will first make every reasonable effort to resolve the matter through rescheduling, re-editing, or another appropriate remedy before any refund is considered.

Copyright Ownership: All photographs taken during the photo shoot remain the exclusive copyright of wheelsnvisuals. The photographer retains full ownership and control over the images.

Licence for Car Owners: Clients will be provided with a PIN to enable them to download a curated selection of high-resolution photos from the shoot, as determined by wheelsnvisuals. Clients would then be granted a non-exclusive, non-transferable, non-commercial licence to use these photos for personal purposes only (e.g. sharing on personal social media profiles, displaying in personal spaces). Clients may not sell, licence, or distribute the photos for commercial purposes without prior written consent from wheelsnvisuals.

Photo Credit Requirement: When sharing or displaying photos provided by wheelsnvisuals (e.g., on social media), clients must include a credit to "wheelsnvisuals" or tag the official wheelsnvisuals account (e.g. @wheelsnvisuals). Failure to provide credit does not revoke the licence but is considered a breach of these Terms.

Photographer's Rights: wheelsnvisuals retains the right to use, display, and sell prints or digital copies of the photos on this website, the client gallery, social media, or other platforms for promotional or commercial purposes. This includes the right to edit, crop, or otherwise modify the photos as deemed appropriate.

No Compensation: Clients acknowledge that no monetary or other compensation will be provided for the use of the vehicle's likeness in the photographs.

Conduct During Shoot: Clients must ensure their vehicle is clean, in good condition, and available at the agreed-upon time and location. Clients should comply with all instructions provided by wheelsnvisuals during the shoot to ensure safety and quality.

Liability: wheelsnvisuals is not liable for any damage to the vehicle or personal property during the photo shoot, except in cases of gross negligence or wilful misconduct. Clients assume all risks associated with bringing their vehicle to the shoot location.

2. Private Photo Shoots & Commercial work

wheelsnvisuals is available for hire for private photo shoots (e.g., bespoke vehicle photography sessions) and commercial work (e.g., advertising campaigns, corporate promotions, or editorial projects). Interested parties may inquire about these services using the contact button on the wheelsnvisuals homepage.

Engagement Terms: Private photo shoots and commercial work are subject to separate agreements, which will outline pricing, scope, deliverables, and usage rights. These agreements will be tailored to the specific needs of the client and may differ from the terms governing free photo shoots or print/digital download purchases.

Copyright and Licensing: Unless otherwise agreed in writing, wheelsnvisuals retains copyright of all photographs taken during contracted shoots. Clients will receive a licence for use as specified in the agreement (e.g., personal use, commercial use, or limited distribution).

Availability: Contracted services are subject to wheelsnvisuals’ availability and discretion. Submitting an inquiry does not guarantee acceptance of the project.

3. Free Photo Shoots

wheelsnvisuals may offer car owners the opportunity to have their vehicles photographed at no cost, subject to the following terms:

Eligibility and Selection: Free photo shoots are offered at the sole discretion of wheelsnvisuals.

Copyright Ownership: All photographs taken during the photo shoot remain the exclusive copyright of wheelsnvisuals. The photographer retains full ownership and control over the images.

Photographer's Rights: wheelsnvisuals retains the right to use, display, and sell prints or digital copies of the photos on this website, social media, or other platforms for promotional or commercial purposes. This includes the right to edit, crop, or otherwise modify the photos as deemed appropriate.

4. Digital Downloads and Purchase of Prints

Clients may download images and purchase prints of photographs taken by wheelsnvisuals of their car, via their PIN-protected online collection, subject to the following terms:

Copyright Protection: All photographs available for download or purchase are the exclusive copyright of wheelsnvisuals. Downloading an image or purchasing a print does not transfer copyright or ownership of the image to the client.

Licence for Buyers:

Prints: Clients who purchase physical prints or their car are granted the right to display the print for personal, non-commercial use only. Prints may not be reproduced, scanned, copied, or used for any commercial purpose without prior written consent from wheelsnvisuals.

Digital Downloads: Clients who download images of their car are granted a non-exclusive, non-transferable, non-commercial licence to use the image for personal purposes only (e.g., personal social media posts, personal device wallpapers). They may not resell, sublicense, distribute, or use the image for commercial purposes without prior written consent from wheelsnvisuals.

Photo Credit Requirement: When sharing digital downloads on social media or other public platforms, clients must include a credit to "wheelsnvisuals" or tag the official wheelsnvisuals account (e.g., @wheelsnvisuals). Credit is not required for private uses (e.g., personal device wallpapers or private display).

Prohibited Uses: Clients may not modify, edit, or create derivative works from the photographs without permission. Unauthorised use, reproduction, or distribution of the photographs is strictly prohibited and may result in legal action.

Order Fulfilment: Orders for digital downloads and prints are processed through Pixieset’s platform. wheelsnvisuals is not responsible for delays, damages, or losses caused by third-party shipping services. Clients are responsible for downloading and storing digital images promptly.

Refunds and Returns: Due to the bespoke nature of prints, all sales are final unless the product is damaged or defective upon receipt. Buyers must contact wheelsnvisuals within 7 days of delivery to report issues.

Pricing and Availability: Prices for prints are subject to change without notice. wheelsnvisuals reserves the right to remove or limit the availability of any photograph from sale at any time.

5. Additional Terms

Website Use: Users may not reproduce, download, or distribute any content from this website (including photos, text, or design elements) without express permission from wheelsnvisuals, except as permitted under these Terms. Unauthorised use may violate copyright, trademark, or other laws.

User Conduct: Users agree not to engage in any activity that disrupts or interferes with the website’s functionality, including hacking, data scraping, or uploading malicious content.

Limitation of Liability: To the fullest extent permitted by law, wheelsnvisuals is not liable for any indirect, incidental, or consequential damages arising from the use of this website, participation in a photo shoot, or purchase of products, including but not limited to loss of data, profits, or property damage.

Indemnification: Users agree to indemnify and hold harmless wheelsnvisuals from any claims, damages, or liabilities arising from their breach of these Terms or misuse of the website or photographs.

Changes to Terms: wheelsnbisuals reserves the right to modify these Terms or the Privacy Policy at any time. Updated versions will be posted on the website, and continued use constitutes acceptance of the new Terms.

Governing Law: These Terms are governed by the laws of Scotland. Any disputes arising from these Terms will be resolved in the courts of Scotland.
